§ 2-2. Dishonored check service fee.

  • (a)

    There is hereby established a service fee as provided for in F.S. § 166.251, and further authorized under F.S. § 832.08(5), as the same may be amended, for the collection of a dishonored check, draft or other order for the payment of money to the city. The service fee shall be in addition to all other penalties imposed by law. Proceeds from this fee shall be paid into the general fund. The amount of the fee for each dishonored check shall be $25.00 if the face value of the instrument does not exceed $50.00; $30.00 if the face value of the instrument is more than $50.00, but does not exceed $300.00; and $40.00 if the face value of the instrument is more than $300.00; or, as may be permitted by law, five percent of the face amount of the instrument, whichever is greater.

    (b)

    In the event any persons' or entities' check, draft or order is dishonored, such person or entity shall be required for a period of 12 months following the date of dishonorment to pay any and all subsequent amounts, fees or charges, of any nature whatsoever, in cash, U.S. Postal money order, certified funds or other means approved and acceptable to the city clerk guaranteeing the payment of such funds.
